Retention permission may be an available route where development has already taken place without the necessary permission, but it should not be assumed that all works can be regularised.
How we can assist
We start by understanding the proposal, reviewing the available planning history and identifying the applicable planning authority and policy framework. The scope of any subsequent work is agreed before instruction.
What is retention permission?
A retention application seeks permission to retain qualifying development already carried out. It is assessed against applicable law, policy and site conditions and may be refused.
Initial review
We examine the planning history, dates and extent of works, current use and any enforcement correspondence. Some categories of development may face legal restrictions on retention.
Supporting information
Accurate as-built drawings, site plans, photographs, relevant assessments and a planning justification may be needed.
Enforcement risk
An application does not automatically suspend enforcement obligations. Specific legal advice may be appropriate where notices or proceedings have been issued.
Information to include with your enquiry
The more accurately we understand the site and proposed development, the more useful an initial response can be.
- Full property address and Eircode, if available
- Existing use and proposed use or works
- Any planning reference numbers, decisions or drawings
- Relevant timescales and known constraints
Questions worth considering
- Can unauthorised works be retained?
- Will retention always be granted?
- What if I received an enforcement letter?
